General terms and conditions
Before confirming your booking please read the following terms and conditions carefully.
Livingwater Estates S. L. is a company registered in Spain with NIF B93211316 trading under the name "Livingstone Estates", hereinafter referred to as "the Company".
Prices
The prices shown on our website www. https://rentals.livingstone-estates.com are per property per night or week where indicated. All prices are in Euros. Prices include all applicable taxes. Our prices are subject to change at any time without being applicable to bookings already confirmed, except for the modification of legal or regulatory taxes set by the competent authorities. The prices include cleaning of the property before and after the client's arrival, all bed linen, maintenance of the property, water, electricity, gas and internet charges (in most cases) and a customer service during business hours (from 09:00 to 17:30). Should you require additional services such as the rental of a parking space, additional cleaning during your stay, a cot, a high chair, etc., please contact us.
Terms and conditions of the booking process
Once you have made a reservation at one of our properties, you will receive a written confirmation confirming the dates and price of the flat you have booked, the terms of payment and any additional services you have purchased. You will receive directions to the property where one of our staff will be waiting to give you the keys, show you the flat and answer any questions you may have.
Booking fees
In order to reserve a property, a non-refundable reservation fee is required. This payment formalises the contractual relationship between the client and Livingwater Estates (Livingstone Estates).
Terms and conditions of the management fee
- The booking fee corresponds to 30% of the total price of the booking, depending on the property.
- Once payment has been made, this booking fee is non-refundable (see our cancellation policy).
- The remaining balance will be automatically deducted from the card used to make the booking fee, or must be paid by bank transfer if preferred, within 30 days prior to arrival. If your arrival date is within 30 days, the full rental price will be deducted at the time of confirmation. If you require special payment conditions, please contact us.
- If you booked your flat through an external provider (e.g. Airbnb, Booking.com, HomeAway etc), please note that you will be bound by the terms and conditions of the external providers, both in terms of payment, rebooking and cancellation.
Booking changes
As a general rule, we cannot change a booking once it has been confirmed. However, should you need to change a booking, please inform us as soon as possible by contacting us via email [email protected]. We will do our best to assist you in the best possible way.
Cancellation Policy
Cancellations must be communicated in writing and justified to our office ([email protected]) and will be subject to the following cancellation fees:
The safety and well-being of our guests is a priority for Livingstone Estates. As changes are continuous and unpredictable due to the COVID-19 outbreak, we have implemented new cancellation / modification or cancellation policies to provide our guests with greater flexibility:
In case of cancellation, the following penalty will be applied:
- More than 30 days before the arrival date: the booking will not be refunded.
- 29 days or less before arrival: loss of 100% of the total rental price.
- In case of "no show": the total amount of the reservation will be forfeited.
In the event that you are unable to travel for the original dates, changes to travel dates will be offered free of charge, subject to availability and prior approval of the property owner.
If due to circumstances beyond our control, the flat booked is not available for your occupancy, the Company reserves the right to relocate you to alternative accommodation, with similar characteristics, at no additional cost. If for any reason we are unable to relocate you or offer alternative accommodation, the booking will be cancelled and a full refund will be made.
In the event that the booking is cancelled for reasons attributable to the client, the amount paid as a handling fee will not be refunded. However, in some situations and with the approval of each owner, the amount paid may be used at a later date for a booking at the same property. This credit will be valid 6 months from the date of issue.
Arrival and departure times
Arrival and departure times may vary depending on the flat you have booked, but as a general rule, arrival time is 16:00 on the day indicated on your booking confirmation, regardless of your arrival time in Malaga.
We always do our best to reduce waiting times. In the event that the property becomes available early, we will do our best to get you in as soon as possible. In the event of any changes to your travel plans, unforeseen circumstances or any changes to your arrival time in Malaga, please let us know as soon as possible.
Please contact us as soon as you arrive at Malaga airport and/or any other chosen airport (or when you are approximately 30 minutes away from the flat) so that we can be there to welcome you. If you are unable to reach your contact person, please contact our emergency number: +34 638 843 625.
On arrival, you will need to complete and sign a rental contract with the owner of the property as well as a form for the National Police (including your surname, first name, ID number, etc.). This procedure is compulsory for anyone over 16 years of age in accordance with Spanish law. Any person refusing to comply with this procedure will not be allowed access to the property.
Please note that an after hours surcharge of 25 € will be applied for arrivals between 20:00 and 22:00. After 22:00 the surcharge will be €50. This amount must be paid in cash on arrival.
Departure from the property
As a general rule, the time of departure from the property and the return of the keys will be before 11:00 on the last day shown on your booking confirmation form. On request of the client and always subject to the availability of the company, the check-out time may be extended. For example, if you need additional time in the flat because your flight is late, we will do our best to respond favourably to your request.
Cleaning, bed linen and towels
The flat is thoroughly cleaned before and after each new guest. Should you require additional cleaning during longer stays, we can arrange this for an additional cost.

Final cleaning will be at the guest's expense; however, please leave the property in the best possible condition, take out the rubbish, wash the dishes as a courtesy to our cleaning staff and future guests.

We provide one large towel (140x70cm) and one medium towel (100x50cm) per person. In case you need more towels during your stay, they are available at the price of 5€ per unit.
Services and special requirements
Our aim is to be able to satisfy all the needs that our clients may require during their stay in one of our properties. So if you require any extra services or have any special requirements, please let us know and we will do everything in our power to meet all your demands.
People with motor disabilities
Unfortunately, we regret to inform you that we do not currently have any accommodation specifically adapted for people with motor disabilities. However, we do have easily accessible accommodation on the same level which may be suitable for these people. Should you require any further information, please do not hesitate to contact us and we will be pleased to help you.
Number of occupants
The maximum number of occupants of a dwelling is that which is established in the descriptions of the dwellings in accordance with the current law of the Autonomous Community of Andalusia. Therefore, it is not permitted to use the property for a number of occupants greater than that which appears on the booking confirmation form. Failure to comply with this rule may be grounds for termination of the contract by the company, reserving the right, if it sees fit, to make the occupants not confirmed in the reservation, or all its occupants, leave the property if this situation leads to behavioural problems, complaints from neighbours, or disrespectful use of the property. If you have any doubts or questions regarding the maximum number of occupants, please let us know and we will be happy to help you.
Behaviour
At Livingstone Estates we expect our clients to enjoy their stay with us as much as possible, but always behaving in a respectful and civil manner, both with the property and with the neighbours. The client is responsible for their own behaviour as well as that of their companions. If for any reason there is any complaint, claim or complaint by the neighbours or by the competent authority for the conduct of one or more occupants for whatever reason, Solaga may proceed to the immediate abandonment of the property of the person causing the problems or all its members if deemed appropriate, without the right to any refund of the cost of your reservation. Furthermore, without prejudice to all of the above, if any damage or breakage were to occur in the property, this would be paid for with the deposit of the security deposit and the company would resort to legal action if the company considered it appropriate to do so.
Each community of owners has its own internal rules and regulations.
As a general rule, we kindly ask you to do the following:
- Do not damage the furniture and/or property
- Not to make noise in the flat, terrace or common areas after 22:00.
- Do not disturb the neighbours by opening and closing doors, dragging suitcases, etc.
- Not to organise noisy parties or celebrations in the flat.
- Not to carry out any illegal activity in the flat.
- No smoking inside the property
- No pets inside the property (without prior authorisation).
- No use of charcoal barbecues
Please note:
- The property owner (or Livingstone Estates on his behalf) has the right to evict any guest who does not respect the property rules without refund.
- Livingstone Estates cannot be held responsible in the event of theft or accident within the property.
- Livingstone Estates cannot be held responsible for noise generated by road works, road works or works of neighbours, construction of buildings and other disturbances caused by external factors.
- Livingstone Estates cannot be held responsible in the event that a property is unavailable due to force majeure.
- Some flat amenities or features may be subject to change, replacement or removal at any time without notice.
Pets
Please note that, as a general rule of the company, pets are not allowed in our properties. They are only allowed in those cases in which it is demonstrated that the animal is for assistance, always with the prior authorisation of the owner of the property, so please contact us if this is your case, so that we can make it possible and facilitate the stay as much as possible. With the exception of these cases, failure to comply with this rule will be grounds for Livingstone Estates to terminate the holiday contract, and will result in the immediate abandonment of the property without the right to reimbursement of the booking costs.
Complaints
If you have any complaints during your stay, please let us know as soon as possible, as Livingstone Estates will not accept any complaints made after the date of your stay in one of our properties. Livingstone Estates will do everything in our power to resolve any complaints that may arise in the most efficient way possible. In addition, we inform you that we have complaint forms available to our customers. We have at your disposal the complaint forms of the Junta de Andalucía.
Deposit
The properties managed by Livingstone Estates require a security deposit, to be paid in cash (or by credit card or bank transfer 30 days prior to arrival) before entering the property or together with the last payment of your booking fee. The security deposit is returnable and will be refunded at the time of your departure, provided that during your inspection no anomaly, breakage or damage to the property, its furniture, appliances and other elements that compose it is found. If this is not the case, Livingstone Estates reserves the right to use part or all of the security deposit to cover the cost of any repairs or replacements that may be required. The security deposit varies from property to property, but is generally between 1000€ and 1500€.
Change of property
Only in the case of force majeure, third party error or due to any anomaly or defect in the reserved property, Livingstone Estates reserves the right to change the property for another of equal or superior category to the one reserved, always with the approval of the client, or to proceed to refund the total cost of the reservation.
Liability
Livingstone Estates is not responsible for lost or misplaced luggage, theft, damage or other accidents beyond the company's control. The client declares that he/she will make proper use of the rented property, exempting Livingstone Estates from any liability, as well as that the client will be responsible for any damage caused by wilful misuse or misuse of the property. Livingstone Estates reserves the right to update any of these conditions at any time should it be required in accordance with the company's own activity.
Livingstone Estates' protection of users' personal information
In accordance with Organic Law 15/1999, on the Protection of Personal Data, the Client is informed of the incorporation of their data into a file, which is the responsibility of Livingwater Estates S.L. (hereinafter the Company), and whose purpose is the management of the client's accommodation. It may also be used, provided that the customer has expressly indicated, to inform of related services, offers and commercial campaigns. The user of the on-line booking services is voluntarily providing personal data (hereinafter, the Personal Data) whose sole purpose is to be able to complete the booking. The card details are either processed through a payment gateway belonging to the bank with which the company has contracted this service, or they are processed in a secure environment, in which case the Company will not be aware of these details. The client may exercise their rights of access, opposition, rectification and cancellation of their data by writing to the Company, Calle Comandante, 1 -3º, 29005 Málaga. The Company guarantees that it has adopted the appropriate security measures in its installations, systems and files. Likewise, it guarantees the confidentiality of the Personal Data, although it will disclose to the competent public authorities the Personal Data and any other information that is in its possession or accessible through its systems and is required in accordance with the legal and regulatory provisions applicable to the case. Users of the on-line booking system guarantee and are responsible, in any case, for the truthfulness, accuracy, validity and authenticity of the Personal Data provided, and undertake to keep them duly updated.
Applicable law and competent jurisdiction
These terms and conditions are governed by Spanish Law. Livingwater Estates S.L. and the users, for the resolution of any dispute that may arise, with respect to its validity, execution, compliance or resolution, in whole or in part, submit, expressly waiving their own jurisdiction or any other that, if any, may correspond to them, to the jurisdiction of the Courts and Tribunals of the city of Estepona. This contract constitutes the complete and integral expression of the agreement between Livingwater Estates S.L. and the user, and replaces all previous pacts, commitments, representations or agreements, both written and oral, that have previously existed between them.
